BRICABOX, LLC PRIVACY POLICY

INTRODUCTION

By visiting this website, you accepted our Terms of Service. The Terms of Service require that you agree to our Privacy Policy which governs our information use and gathering practices. Here at BricaBox we want you to be fully informed of our practices and therefore we highly recommend that you take a few minutes to read our Privacy Policy.

Any capitalized term not defined in this Privacy Policy has the meaning which we lay out in the Terms of Service. From time to time, we will update this Privacy Policy and will do our best to keep you abreast of these changes by posting a notice on the Website.

We take protecting your personal data very seriously. All persons using the Website are required to meet the terms of our Privacy Policy. That being said, we ask you to be careful and use caution when providing your personal data on a bricabox or the Website. Unfortunately, there is no way we can be responsible for the actions of other Website users.

By registering to use the Website, you agree (1) to comply with the terms and conditions of this Privacy Policy, and (2) that BricaBox and any user may collect, view, or otherwise use your personal data as described in this Privacy Policy or the Terms of Service. Personal Data may be may be collected, viewed, or otherwise used by BricaBox or Website user(s) in the country where it was collected as well as other countries (including the United States) where laws regarding collecting, viewing, or otherwise using personal data may be less stringent.

COLLECTION OF INFORMATION

Once you register with BricaBox and sign on to the Website, you are not anonymous to BricaBox. When registering, you provide personal data, which includes a user ID, a password, and may sometimes include an email address and a photo. BricaBox may also record your IP address when you submit information. Also, when you purchase premium services from BricaBox, you must provide necessary information to process your credit card payment, including your billing address.

BricaBox may make an address book feature available to Website users which would allow Website users to maintain a list of third parties’ contact information. This information will not be used by BricaBox for any purpose.

To protect your account information, please keep your password secure. You can also decline to share such personal data with us by not registering. Further, you may opt to remove any personal data from our database by canceling your account. Note: upon cancellation of your account, your personal data will be removed from our active database but some of your personal information may remain in our inactive archives.

BricaBox does not intentionally gather personal data about visitors who are under the age of 13.

Cookies and Passive Data Collection

BricaBox automatically receives and records information on our server logs from your browser, including your IP address, cookie information, and the page you request.

Users should be aware that other websites visited before entering BricaBox might place personally identifiable information within a user's URL during a visit to their website, and BricaBox has no control over such websites. Accordingly, some of this information may be logged by a subsequent website that collects URL information.

Content and Use of Networks

When you post content in any bricabox or on the Website, other Website users may have access to such Content. BricaBox also tracks content that you have uploaded to a bricabox or the Website. In addition, the Website allows other Users to invite you to join or view a bricabox.

Because you may voluntarily disclose personal data by interacting with the Website or a bricabox, you should be careful about the information you choose to disclose. For example, you may disclose personal data by posting comments that contain intimate details known only to you or by using an avatar that utilizes a photo of yourself. BricaBox does not control that disclosure and is not liable in any way for anyone's use or misuse of the information in the disclosure. BricaBox therefore suggests you use your best judgment when disclosing your content or personal data.

USE OF INFORMATION

Personally Identifiable Information

BricaBox may send you administrative messages and email updates regarding your account, a bricabox, or the Website. BricaBox may also send you notices of new content in which you may be interested when you have subscribed to such notices. BricaBox may send you primarily promotional messages. You can choose to opt out of promotional messages and new content notices by customizing your account. You may opt out of receiving administrative messages by canceling your account.

Cookies and Passive Data Collection

BricaBox uses cookie, IP address, and URL information to improve the content of the Website, bricaboxes, and to provide enhanced features to Website users. BricaBox uses cookies to save Website users' IDs and session validators, and may use them to provide tailored products and services to those users, as they become available.

IP Addresses also help us to diagnose problems with the server, to administer the Website, and to otherwise provide service to Website users. IP addresses may be disclosed to a third party if the law or legal process requires it, or as necessary to protect the rights or property of BricaBox, Website Users, or the general public.

DISCLOSURES

BricaBox may need to provide your personal data to third parties to deliver specific services to you (such as hosting services, support services, or credit card payment processing). These third parties are required not to disclose your personal data and not to use your personal data other than to provide the services requested by BricaBox.

Website Users

The Terms of Service require each Website user to comply with applicable laws (e.g., CAN-SPAM) and BricaBox’s rules with respect to use the personal data of others, including this Privacy Policy.

This includes, but is not limited to, agreements not to:

  • use any personal data disclosed to it by BricaBox for any purpose other than using the Website or a bricabox
  • harvest any email addresses from the Website or any bricaboxes
  • knowingly collect any information from or develop any bricaboxes that are targeted at children under the age of 13

Law Enforcement

BricaBox may disclose personal data if required by a subpoena or other judicial or administrative order, where required by law, or, at our sole discretion, where we deem necessary to protect the safety of any individual or the general public or to prevent violation of our Terms of Service or the rights of BricaBox or any third party.

BricaBox Affiliates

Although BricaBox currently does not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, "affiliates"), it may in the future. BricaBox may share some of all of your personal data with these affiliates, in which case we will seek to require our affiliates to honor this Privacy Policy.

Change of Ownership

In the event of a change in ownership, or a merger with, acquisition by, or sale of assets to, another entity, we reserve the right to transfer all of BricaBox’s user information, including email addresses, to a separate entity. BricaBox will notify users of such a transfer, and users may choose to continue, modify, or cancel their registration information at that time. This means that you can deactivate your account if you are concerned about your personal data being transferred to a new owner.

Security

BricaBox uses industry standard security measures to protect the loss, misuse and alteration of the information under our control. Although we make good faith efforts to store the information collected by BricaBox in a secure operating environment that is not available to the public, BricaBox cannot guarantee complete security. Further, while we work hard to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from illegally obtaining this information.

Updating or Removing User Information

Users may, at any time, choose to correct or update the information they have submitted to BricaBox, by going to their account. Users may remove their user information by canceling their account. However, even if you update or remove your information from our database, your personal data may be retained in our backup files and archives.

No Spam Policy

Our Terms of Service prohibit all users from engaging in any activity involving the sending of email in violation of applicable law. Violations of these policies may result in immediate termination of service and legal action against any spammers.

Any unauthorized use of BricaBox computer systems is a violation of the Terms of Service and certain federal and state laws, including without limitation the Computer Fraud and Abuse Act (18 U.S.C. section 1030 et seq.). Such violations may subject the sender and his or her agents to civil and criminal penalties.

The Website will allow Website users to contact each other via email. When interacting with the Website, BricaBox encourages users to choose an email address where they will be comfortable receiving email responses from other Website users.

International Users

By visiting the Website and providing BricaBox with data, you acknowledge and agree that, due to the international dimension of BricaBox, BricaBox may use the data collected in the course of your relationship for the purposes identified in this Privacy Policy or in BricaBox’s other communications with you, including the transmission of information outside your resident jurisdiction. Please understand that such data may be stored on servers located in the United States where laws protecting personal data may not be as stringent as the laws in your jurisdiction. By providing BricaBox with your data, you consent to the transfer of such data.

BricaBox reserves the right to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification may be posted on the Website, and a user's continued use of the Website will signify agreement to such changes.
